Mexico, the second-largest medical device consumer market in Latin America, adopts a three-tier risk classification system, different from Colombia and Peru. It features the unique RELIANCE equivalence review pathway, with major revisions to registration and renewal policies rolled out in 2026. Based on the content shared at the Beijing CMEF open class, this article breaks down regulatory frameworks, classification rules, registration routes, local representative requirements, documentation, amendments, and post-market surveillance essentials to support Chinese manufacturers entering the Mexican market.

一、Regulatory Framework Overview

Governing Authority: COFEPRIS (Federal Commission for Protection against Sanitary Risk)

Primary Legislation: LGS (General Health Law)

Implementing Regulations: RIS (Regulation for Health Supplies); supplemented by the FEUM Compendium for Medical Devices (technical specifications and grouping rules); mandatory NOM official standards (NOM-241 Quality System, NOM-137 Labelling, NOM-240 Medical Device Vigilance).

Registration Validity: Initial certificate valid for 5 years. Under the 2026 reform, validity extends to 10 years after the first renewal.

二、Risk Classification (3-Tier System, Not IMDRF 4-Tier)

Risk ClassDefinitionExamples
Class INon-invasive, with fully verified safetyBandages, general face masks, stethoscopes
Class IIPenetrates the human body, contact duration ≤30 daysSyringes, catheters, blood glucose meters
Class IIIImplanted / invades the human body for more than 30 days; high-risk innovative devicesPacemakers, heart valves, implantable prostheses
IVD products are not classified separately and fall into Class I/II/III. High-risk IVDs such as HIV and hepatitis B screening assays are directly assigned to Class III.
Important Reminder:Class I does NOT equal exemption from registration. Check the 2025 low-risk list. Certain previously exempt products (N95 masks, orthodontic archwires) are subject to mandatory registration during the 2025–2028 transition period. Only products listed in Annexo II require an Aviso notification, no full registration.
三、Three Registration Pathways

(一)Standard Conventional Pathway: COFEPRIS-04-060
Available for all risk classes. FSC (Free Sale Certificate) from the country of origin is required. Strict deadlines apply for administrative and technical deficiency responses; applications will be rejected if overdue.

(二)RELIANCE Equivalence Pathway: COFEPRIS-04-050 [Key Pathway]
Approves registrations based on review outcomes from recognized reference jurisdictions: the US FDA, Canada, EU, China, Japan, South Korea, UK, Australia and other IMDRF member economies. Common Misconception: Holding CE/FDA certificates alone does not guarantee simplified review. It must be demonstrated that product configuration, intended use, manufacturing site, technical documentation and labelling all comply with local Mexican regulatory requirements.
(三)Simplified Pathway for Low-Risk Devices: COFEPRIS-04-070
For products listed in Annexo-I. Simplified technical documentation is acceptable, but an FSC certificate is still mandatory.
四、Local Entity Requirements for Overseas Manufacturers

MRH (Mexican Registration Holder):Foreign manufacturers must appoint a local Mexican legal entity as the MRH. The MRH acts as the certificate holder and bears full post-market responsibilities including importation, adverse event reporting and variation filing. The authorization document requires Hague apostille or consular legalization.
Business Premises:Aviso de Funcionamiento notification only. No physical business licence is issued; manufacturers submit applications online, subject to subsequent inspection by regulators.
Sanitary Responsible Person (Responsable Sanitario):Mandatory appointment, registered for tax purposes, with full legal liability for premises compliance.
Quality System:Domestic Mexican manufacturers are subject to on-site BPF inspections. For imported products, ISO 13485 / MDSAP audit reports are accepted as equivalent evidence.
Language:Labels and instructions for use must be in Spanish.
五、Differences in Technical Documentation by Risk Class

  • Class I: Product information, drawings, raw material records, test reports, sterilisation and packaging records. Biocompatibility data and clinical reports are not required.
  • Class II: Full Class I documentation + ISO 10993 biocompatibility data, clinical evaluation (minimum 3 published literature references). Electrical safety reports are compulsory.
  • Class III: Complete in-depth technical dossier; full sterilisation validation, accelerated and real-time stability studies, rigorous clinical evaluation and expert summary. Innovative products without overseas clinical data need to conduct clinical trials within Mexico.
六、Amendments & Renewals (Key Changes under the 2026 Reform)

(一)New Renewal Rules

Initial registration: 5-year validity; validity becomes 10 years after the first successful renewal.

First renewal: Application due 150 calendar days before expiry, review timeline 45 working days. Submission of adverse event records, complaint and recall history for the prior 3 years, plus valid ISO 13485 certificate is required.

Second and subsequent renewals: Simplified procedure for fast clearance.

(二)Two Types of Amendments: Administrative Amendments / Technical Amendments
Administrative Amendments (name, address, distributor changes):Fastest turnaround 10 working days; some are processed instantly.
Technical Amendments (manufacturing site, material, sterilisation, new software features):Post-2025 simplified review cycle: 11 working days. Fee equals 75% of the registration fee for the relevant risk class.
For SaMD: Bug fixes do not require filing; algorithm updates and intended use modifications must be submitted as technical amendments.
七、Additional Requirements

(一)Post-Market Surveillance: Tecnovigilancia (NOM-240)
  • Severe fatal incidents: Report within 2 working days
  • Incidents causing harm: Report within 10 calendar days
  • All other adverse events: Report within 30 calendar days Enterprises shall establish a CAPA and complaint closure system. Regulators may order seizure, sales suspension or market recall.

(二)Reference Government Fees (MXN, 2026)
Risk ClassNew RegistrationRenewal
Class I16,49912,374
Class II24,19818,149
Class III30,79823,098
Agent, translation and document notarisation fees excluded.
八、Closing Remarks

As Latin America’s second-largest medical device market, Mexico offers an efficient market access route for Chinese manufacturers with existing FDA or CE certification via the COFEPRIS equivalence review pathway. Nevertheless, local representative arrangements, Spanish labelling, post-market surveillance and other local compliance details remain critical to registration success. Prior compliance planning is essential to capture market opportunities in Latin America. This Latin America market access guide series will continue to be updated. Our next chapter will unpack medical device registration rules for other Latin American countries.Contact Wiselink for further inquiries!
