Colombia is an important medical device market in Latin America. As the regulatory authority, INVIMA runs a distinctive automatic registration pathway, through which low- and medium-risk products can obtain certificates rapidly. Many domestic medical device companies targeting South America choose Colombia as their first market entry point. Combined with the takeaways from the Beijing CMEF open class, this article sorts out practical key points covering regulatory framework, risk classification, registration routes, document checklists, variation & renewal rules, and post-market surveillance, to help Chinese enterprises avoid detours.

一、Overview of Regulatory Framework

Competent Authority: INVIMA (National Institute for Food and Drug Surveillance)

Umbrella Law: Ley 9 de 1979, National Health Code

Core Regulation: Decreto 4725-2005 (Revised 2017), Medical Device Regulation; IVDs follow Decreto 3770-2004

Marketing Authorization: Registro Sanitario (Sanitary Registration Certificate), valid for 10 years, one of the longest validity periods in Latin America.

Division of Responsibilities: The Ministry of Health establishes regulatory standards; INVIMA handles registration review, inspection and post-market surveillance.

二、Risk Classification (4-Tier System, Aligned with IMDRF)

Risk ClassRisk DescriptionTypical ProductsRegistration Route
Class ILow risk, intact skin contactBandages, stethoscopes, examination glovesAutomatic Registration
Class IIaMedium risk, short-term invasive / broken skin contactSyringes, catheters, sphygmomanometersAutomatic Registration
Class IIbHigh risk, long-term invasiveVentilators, dialysis devicesTechnical Review
Class IIIVery high risk, life-sustaining, implantable, drug-containing / animal-derivedPacemakers, prosthetic jointsTechnical Review
IVD reagents have separate classification:Categoría I/II for automatic registration; high-risk Categoría III requires technical review.
Classification Rules:Judged by intended use; multi-purpose products follow the highest risk class; kits are classified by the highest-risk component.
三、Two Core Registration Pathways

Pathway 1: Automatic Registration (Class I, IIa; IVD I/II)
Review Timeframe:Approved within 2 working days once documents are complete
Note:Not exempt from inspection! INVIMA reserves the right for post-hoc verification and may request supplementary documents later.
Document Requirements:
Class I:Basic administrative documents + technical files; risk analysis and clinical documentation are not required.
Class IIa:Mandatory additional submission of ISO 14971 risk analysis report and list of applicable technical standards.

Pathway 2: Technical Review (Class IIb, III; IVD III)
Review Body:Sala Especializada, Specialized Medical Device Review Committee
Statutory Review Period:90 working days, only one chance to submit supplementary information, and responses must be provided within 90 calendar days.
Mandatory Document:Complete ISO 14971 risk management, biocompatibility, sterilization validation, and clinical evidence.
Class III:Clinical trial report is preferred; publicly available literature of equivalent products is also acceptable.
Class IIb: Clinical Evaluation Report (CER) is accepted, yet the regulator retains the right to request additional clinical trials.
四、Local Entity Requirements for Overseas Manufacturers

Registration Holder (Titular):Overseas manufacturers may hold the certificate directly, or authorize a local Colombian agent. The authorization document must obtain an Apostille certification under the Hague Convention.
CCAA Warehouse Certificate:Importers’ warehouse premises must hold a CCAA storage capability certificate issued by INVIMA, which must be valid for each import shipment.
Technical Responsible Person:A local professional technical responsible person must be appointed to assume statutory compliance obligations.
Quality System:ISO 13485:2016 and MDSAP are accepted as equivalent proof.
Mandatory Requirement:All labels, instructions for use and operation manuals must be in Spanish.
五、Core Document Checklist

Legal Document Package:Application form, certificate of good standing of the company, payment proof, power of attorney, Apostilled Free Sale Certificate (CVL), ISO 13485 certificate, final Spanish version of labels and IFU.
Technical Documents by Risk Class:
  • Class I: Product information, drawings, validation reports, sterilization records (if applicable), manuals; no risk analysis or clinical data required.
  • Class IIa: All Class I documents plus ISO 14971 risk analysis report.
  • Class IIb / III: All Class IIa documents plus biocompatibility test reports, sterilization validation, packaging integrity verification, clinical evaluation / clinical trial reports.
六、Variation and Renewal Rules

Certificate Validity:Valid for 10 years. Renewal application must be submitted at least 3 months before expiry; expired certificates will be cancelled directly and require re-registration. Renewals retain the original registration number with suffix R1/R2/R3.
Two Types of Variations:
  • Minor Variations (no impact on safety and effectiveness): Automatic processing, completed within 2 working days. E.g., company name/address change, label format revision, model addition or removal.
  • Major Variations (design, material, process, indication, sterilization method): Not eligible for automatic variation; must go through technical review or new registration.
七、Other Requirements

(一)Post-Market Vigilance, Tecnovigilancia (Resolución 4816-2008)
  • Serious adverse events: Report to INVIMA within 72 hours.
  • General adverse events: Summarized and reported quarterly.
  • Enterprises must establish an internal vigilance system with assigned responsible persons; recalls and market withdrawals shall be implemented when risks arise.

(二)Official Fee Reference (2026, Priced in UVB)
  • Automatic Registration for Class I / IIa: 321.91 UVB
  • Registration for Class IIb / III: 364.36 UVB
Note: UVB is Colombia’s Basic Value Unit. Official fees exclude translation, agency and Apostille certification costs.
八、Closing Remarks

For domestic high-risk medical devices entering the Japanese market, registration document preparation is only one part of the work. It requires building a full compliance system: from preliminary classification and pathway assessment, MAH/D-MAH entity setup, factory FMR registration, competitor benchmarking, substantial equivalence analysis, PMDA consultation, QMS system audit, to continuous post-market compliance.
